MORNING PEOPLE PRIVACY NOTICE.

MORNING PEOPLE S.A. DE C.V., (hereinafter MORNING PEOPLE), with address located at Justo Sierra 2150, interior 302, in the Ladrón de Guevara neighborhood, Guadalajara, Jalisco, C.P. 44600; will be responsible for the processing and safeguarding of your personal data, which will be obtained through MORNING PEOPLE, and, where applicable, will be authorized for the use and safeguarding of the same, without prejudice to the fact that it may designate third parties as processors, in accordance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (hereinafter the “Law”), its Regulations and the Guidelines of the Privacy Notice, makes available to you this Privacy Notice (hereinafter the “Notice”) which establishes the terms and conditions under which MORNING PEOPLE will carry out the processing to which the personal data provided through the website www.morningpeople.mx (hereinafter the “Site”) or other means will be subject:

FIRST. – PERSONAL DATA AND CONSENT FOR THEIR PROCESSING. MORNING PEOPLE, through the Site, or when obtained through other sources permitted by law, will collect the following personal data: (i) Name and, (ii) Contact information such as cell phone number and email address, (iii) Country of residence, (iv) IP address (hereinafter the “Personal Data”).

Likewise, you are informed that we will never request personal data considered sensitive by law, so in case MORNING PEOPLE requires sensitive data, these will be requested with all the formalities established by law, obtaining your express and written consent for their processing. Regardless of the Personal Data that will be requested from you in terms of the above, in the section or form for talent hiring, the following information may be requested, which will not be considered as Personal Data, but will allow us to provide you with a complete and specific service, namely: (i) Area (Management, press, commercial, influencer marketing, among others); (ii) Information (Hiring, press, casting, various); (iii) Company; (iv) Position; and, (v) Institutional email.


SECOND. – PURPOSE OF PROCESSING. 

MORNING PEOPLE collects Personal Data by virtue of the legal relationship that exists between it and the user of the Site for the following main purposes: (i) Hiring; (ii) Promotion and placement of talent according to the needs of our clients; (iii) Providing the services requested by you; (iv) Sending information about new events or talent placement opportunities; (v) Improving communication with Site users interested in hiring the services offered by the Site in order to strengthen and facilitate the relationship between them; (vi) Providing customer service, clarification of doubts or complaints about the services; as well as (vii) Integrating and keeping our client database up to date. 

Additionally, MORNING PEOPLE collects Personal Data for certain secondary purposes, which although not necessary, allow and facilitate the opportunity to provide you with better service such as: (i) Information about new talents; (ii) Marketing; (iii) Advertising (Newsletters, as well as commercial and promotional communications); (iv) Statistics for analysis of Site traffic and usage; (v) Profile creation for determining tastes and preferences; (vi) Invitation to MORNING PEOPLE’s events of interest, or those they sponsor, produce, collaborate on; (vii) Sending promotional information according to your interests; (viii) Evaluating the quality of the service we provide you; (x) Invitation to events related to MORNING PEOPLE platforms and any other event in which any of our talents may participate; and, (xi) Sending you news. 

By written request to the email address hello@morningpeople.mx and in accordance with the necessary mechanisms for cancellation as indicated in the Notice, you may express your refusal for your Personal Data to be used for secondary purposes that did not originate from the legal relationship with MORNING PEOPLE.

THIRD. – TRANSFER OF PERSONAL DATA. 

By means of this Notice, you agree that your Personal Data may be transferred by MORNING PEOPLE to interested parties related to the primary and secondary purposes. The foregoing is for the purpose of sending you, by any means, commercial communications about the products or services offered by said companies or individuals that may be of interest to you, as long as it is related to the aforementioned purposes. In the event that you oppose the transfer (permitted by law) of your Personal Data to third parties, you may exercise your right to object and even request that they be removed from MORNING PEOPLE’s database. When personal data has been transmitted prior to the date of rectification or cancellation and continues to be processed by third parties, the data controller must inform them of such request for rectification or cancellation, so that they may also proceed with it.

FOURTH. – REVOCATION OR LIMITATION OF YOUR CONSENT. 

The authorization for the Processing of Personal Data provided through the Site may be revoked at any time in accordance with the following: 

  1. ARCO Rights. You may exercise your right of access, rectification, cancellation, or opposition in accordance with the provisions of the Law, by written request to the email address hello@morningpeople.mx indicating: (i) name and email address or other means to communicate the response to your request, (ii) the documents proving your identity or, if applicable, your legal representation, (iii) a clear and precise description of the Personal Data concerning which any of the aforementioned rights is sought to be exercised, (iv) any other element or document that facilitates the location of the Personal Data, and (v) the modifications to be made. Additionally, you must provide documentation supporting your request.
  2. Revocation of Consent. Consent for the Processing of your Personal Data may be revoked at any time by the data subject or through their legal representative, by written request to the email address hello@morningpeople.mx indicating: (i) name and email address or other means to communicate the response to your request, (ii) the documents proving your identity or, if applicable, your legal representation, (iii) the express manifestation to revoke your consent for the Processing of your Personal Data, (iv) any other element or document that facilitates the location of the Personal Data, and (v) the modifications to be made. Additionally, you must provide documentation supporting your request.

  3. Limitation of Use and Disclosure of Personal Data. At any time, you may limit the use or disclosure of your Personal Data for: (i) your registration in an automated file owned by MORNING PEOPLE or (ii) receiving communications or promotions from MORNING PEOPLE. This can be done by written request to the email address hello@morningpeople.mx indicating: (i) name and email address or other means to communicate the response to your request, (ii) the documents proving your identity or, if applicable, your legal representation, (iii) the express manifestation to limit the use and/or disclosure of your Personal Data, (iv) any other element or document that facilitates the location of the Personal Data, and (v) the modifications to be made. Additionally, you must provide documentation supporting your request.
  4. MORNING PEOPLE will communicate through email, within a maximum period of 15 (fifteen) business days (counted from the date the corresponding request was received, duly integrated), the determination adopted. If deemed appropriate, the decision will be effective within 15 (fifteen) business days from the date the response is communicated. This is in accordance with the provisions of the Law; the aforementioned deadlines may be extended once for an equal period, provided that the circumstances justify it. If the information provided in your request is incorrect or insufficient, or if the corresponding accreditation documents are not attached, we may request, within 15 (fifteen) business days following the receipt of the request, that you provide the necessary elements or documents to process it. You will have 10 (ten) business days to respond to the request, counted from the day following its receipt. Failure to respond within this period will result in the request being considered as not submitted.
  5. MORNING PEOPLE may deny access to Personal Data, or refuse to rectify or cancel them, or grant opposition to their Processing when: (i) the requester is not the Data Subject or the legal representative is not duly accredited for it; (ii) the Personal Data of the requester are not found in its database; (iii) rights of third parties are violated; (iv) there is a legal impediment or, if applicable, there is a resolution of competent authority restricting access or preventing rectification, cancellation, or opposition to them; and (v) the rectification, cancellation, or opposition has already been carried out.


FIFTH. – SECURITY MEASURES OF PERSONAL DATA. 

MORNING PEOPLE has implemented the necessary and sufficient measures to ensure that this Notice is respected at all times, establishing security measures, administrative, technical, and physical, that facilitate the protection of your Personal Data, as well as to prevent any damage, loss, alteration, destruction, or unauthorized use of the same. Likewise, both MORNING PEOPLE and its personnel who have access to your personal data in the exercise of their functions or intervene in any phase of the processing, undertake to maintain confidentiality regarding your personal information. Any security breach occurring during the Processing will be immediately notified by MORNING PEOPLE.

 

SIXTH. – MODIFICATIONS TO THE NOTICE. 

We reserve the right to make modifications or updates to this Notice at any time, to address legislative developments, internal policies, or new requirements for the provision of services offered by MORNING PEOPLE, which will be informed to you through various means, such as email or by publication on this Site.

By providing information via internet, telephone, or in person, you consent to this Notice.
